PURCHASE RULES

The rules of the online store www.amoti.lt define the conclusion of a purchase contract and the obligations of the parties.

1. Basic provisions

1.1. These rules of purchase and sale (hereinafter referred to as the Rules) establish the mutual rights, obligations and responsibilities of the person purchasing goods in the online store www. amoti.lt (hereinafter referred to as the Buyer) and the seller when the Buyer purchases goods in the online store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.

2. Conclusion of a purchase and sale agreement

2.1. The purchase and sale agreement between the Buyer and the Seller is considered to be concluded from the moment when the Buyer, having created a shopping cart in the online store, specified information about himself: name, surname, delivery address, e-mail, phone number and selected a payment method and having familiarized himself with these Rules, clicks the "Order" button, and is valid until the obligations under this agreement are fully fulfilled. In cases where the Buyer does not agree with all or a certain part of the Rules, he must not place an order.

3. Seller's rights

3.1. The Seller has the right to temporarily or indefinitely terminate the operations of the online store, having previously notified the Buyers, and undertakes to send the ordered goods for which the Buyer has already paid.

3.2. The Seller has the right to unilaterally amend these Rules by publishing the amended Rules on the website of the online store. The amendments shall enter into force from the moment of publication for all transactions concluded after the publication.

3.3. The Seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.

4. Seller's responsibilities

4.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the online store. The Seller does not provide any guarantees that the online store will operate uninterruptedly or that data transmission will be error-free. The Seller is not liable for any losses of the Buyer related to malfunctions of the online store and/or data transmission errors.

4.2. The Seller undertakes to send the ordered goods to the Buyer within 7-10 working days from the date of payment for the goods.

4.3. The Seller undertakes to replace the goods purchased by the consumer free of charge if they are of an unsuitable size with similar goods of different dimensions, shape, color, model or complexity. If the Seller does not have suitable clothes for replacement, the Buyer has the right to return the clothes to the Seller and recover the price paid for them. In this case, the Seller undertakes to return the money paid to the Buyer within 10 working days and is exempt from liability for failure to deliver the goods.

4.4. The Seller undertakes to comply with other requirements set out in these rules.

5. Buyer's rights

5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules and the legal acts of the Republic of Lithuania.

5.2. The Buyer (consumer) has the right to withdraw from the contract for the purchase and sale of goods concluded in the online store with the Seller by notifying the Seller in writing within 14 business days from the date of delivery of the goods. The Buyer has the right to withdraw from the contract for the purchase and sale of goods with the Seller only if the goods are of good quality, have not been damaged and their appearance has not changed significantly.

5.4. The Buyer has other rights provided for in the Rules and legal acts of the Republic of Lithuania.

5.5. Payments can be made using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas electronic banking services. Payments are available in euros. Payments are processed using the MakeCommerce.lt payment platform.

6. Buyer's obligations

6.1. The Buyer must pay the price of the goods and their delivery, as well as other payments (if such are specified when concluding the contract) and accept the ordered goods.

6.2. The production of the Goods shall commence and the Seller shall commence the performance of the purchase and sale agreement only when the Seller receives a notification from the Buyer's bank about the payment for the selected Goods.

6.3. The Buyer must comply with other requirements set out in the Rules and legal acts of the Republic of Lithuania.

7. Joint responsibility

7.1. The Buyer is responsible for the accuracy of the data provided. The Buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided.

7.2. The parties shall be liable for any breach of the purchase and sale agreement concluded using the online store in accordance with the procedure established by the legal acts of the Republic of Lithuania.

7.3. The Seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.

7.4. The seller is not responsible for changes in the quality of the garment if the buyer has used the garment without following the washing and other care instructions specified on the label.

7.5. By this agreement, the Seller warns that the color, structure or other properties of the fabric may change when wearing or washing the garment.

7.6. In the event of damage, the at-fault party shall compensate the other party for direct losses incurred due to its fault.

8. Processing of personal data

8.1. By clicking the "Order" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to provide the Seller with his personal data and do not object to the Seller processing the personal data provided by the Buyer and (or) his representatives for the purposes of identifying the Buyer and (or) his representatives, concluding and executing contracts (online shopping), and for direct marketing. The Seller indicates that the Seller will not process the personal codes of the Buyer (if the Buyer is a natural person) and his representatives for the purpose of direct marketing.

8.2. By clicking the "Order" button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives are informed of his right to access his personal data processed by the Seller and how it is processed, to demand correction, destruction of his personal data or suspension of processing of his personal data when the data is processed in violation of the provisions of the law, and to object to the processing of his personal data.

8.3. By clicking the "Order" button, the Buyer confirms that he and his representatives are aware that they have the right to refuse to provide their personal data, but understand that personal data is necessary and necessary to unambiguously identify the Buyer and (or) his representatives for the purposes of concluding and executing contracts (online trading) and that without providing personal data and (or) not agreeing to their processing for the purposes specified above, he will not be able to conclude and (or) execute the contract.

9. Sending information

9.1. The Seller sends all informational messages and notifications for direct marketing purposes to the email address provided in the Buyer's registration form.

9.2. The Buyer sends all messages and questions using the data provided in the Seller's online store.

10. Final provisions

10.1. The Buyer and the Seller agree that all information provided on the Seller's online store website (including, but not limited to, these Rules, information about the Seller, the offered goods and services and their characteristics, the procedure for the Buyer's right to withdraw from the purchase and sale agreement, the Seller's product maintenance services and guarantees (if any)) shall be deemed to have been provided to the Buyer in writing.

10.2. All disputes arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved through negotiations. If an agreement cannot be reached, the disputes shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
